Notice No. 28, 2011 of the Ministry of Commerce and the General Administration of Customs on Applying Rare Earth Export Quota License Administration to Rare Earth Ferroalloy
Issued by: Ministry of Commerce General Administration of Customs Notice No. 28, 2011 Dated: May 16, 2011 For the purpose of strengthening and standardizing the administration of the export of rare earth and in accordance with the provisions of the Foreign Trade Law of the People’s Republic
For the purpose of strengthening and standardizing the administration of the export of rare earth and in accordance with the provisions of the Foreign Trade Law of the People's Republic of China and the Regulation of the People's Republic of China on the Administration of the Import and Export of Goods, administration measures on the export of rare earth ferroalloys are hereby announced as follows:
I. As of May 20, 2011, "other ferroalloys containing more than 10% rare earth minerals by weight" (HS code: 7202999100) shall be included into the export quota license administration system of rare earth.
II. Enterprises that export the above goods must satisfy the qualification of applying for export quota of rare earth (Notice No. 77, 2010 of the Ministry of Commerce), obtain the export quota of rare earth, and in compliance with relevant provisions of the Administrative Measures on Commodity Export License (Decree No. 9, 2010 of the Ministry of Commerce) and the Catalogue of Commodities under Export License Management 2011 (Notice No. 77, 2010 of the Ministry of Commerce and the General Administration of Customs), apply export license with the Quota and License Administrative Bureau or local Commissioner's Offices of the Ministry of Commerce. Enterprises shall present the export license to the customs for clearance.
III. A transitional period from May 20, 2011 to June 30, 2011 shall be set up for contracts on the above goods signed before (or on) May 20, 2011. The Quota and License Administrative Bureau of the Ministry of Commerce or the provincial commerce authority of where the enterprise is located shall issue export license for rare earth ferroalloys to the relevant party to the contract before (or on) June 5, and the enterprise shall file export declaration to the customs before June 30.
IV. As of July 1, 2011, enterprises shall present export quota licenses of rare earth issued by the Quota and License Administrative Bureau or local Commissioner's Offices of the Ministry of Commerce to the customs for clearance.
V. The Ministry of Commerce and the General Administration of Customs shall be responsible for the interpretation of this Notice.
